Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),   Having regard to the friendly settlement decisions and final judgments transmitted by the Court to the Committee in these cases and to the violations established therein;   Recalling that the violations of the Convention found by the Court in the cases in the appended list primarily concern the right to freedom of expression (Article 10); a number of cases also contained other violations: Çapan (71978/01), Çapan No.   2 (29849/02), Çolak and Kasımoğulları (29969/07), Demirel and Ateş (10037/03), Demirel and Ateş No. 2 (31080/02), Demirel and Ateş No. 3 (11976/03), Halis Doğan No. 2 (71984/01), Falakoğlu (16229/03), Falakoğlu and Saygılı (11461/03), Falakoğlu and Saygılı (22147/02), Gözel and Özer (43453/04), Güzel No. 2 (65849/01), Karakoyun and Turan (18482/03), Özer remedy in this respect (violation of Article 6) in the cases of Fatih Taş (36635/08), Yavuz and Yaylalı (12606/11) (the proceedings in the two cases were closed as indicated in the Court’s judgments and general measures were adopted in the Ormancı group of cases (see Final Resolution CM/ResDH(2014)298 ));   -           lack of assistance of a lawyer in police custody (this issue was examined under the Salduz group of cases (see Final Resolution CM/ResDH(2018)219 ));   -           inadmissibility of appeal on the ground that level of fine was below statutory minimum for appeal (Article 6) in the cases of Bayar (55060/07) and Özalp (48583/07) (this issue is being examined under Bayar and Gürbüz (37569/06) group of cases);   -           incompatibility of the imposition of a prison sentence on the applicant under Article 8 § 2 of Law No. 3713, in its form at the material time, with the principle “ nulla poena sine lege ” (Article 7) in the case of Ünsal Öztürk (29365/95) (this issue was examined under the case of Başkaya and Okçuoğlu (23536/94) see Final Resolution   ResDH(2006)79 ));   Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:   -           of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and -           of general measures preventing similar violations;   Recalling that in order to provide the applicants with redress for violations found by the Court, the possibility of obtaining the reopening of judicial proceedings impugned by the Court’s judgments was introduced in 2005, and supplemented in 2012 to fill certain gaps, and was applicable to all cases pending before the Committee for supervision of execution at the time;   Recalling also the existing possibility to obtain the erasure of criminal records following the judgments of the Court;   Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation;   Having examined the action plan and action report provided by the government indicating that individual measures adopted in order to give effect to the judgments (see documents DH-DD(2018)328 and DH-DD(2016)842 ) including the information provided regarding the payment of the just satisfaction awarded by the Court;   Recalling, finally, that the question of the general measures required in response to the shortcomings found by the Court in the present judgments continues to be examined within the framework of the Bayar , Öner and Türk , Döner and Others and Müdür Duman cases (see the relevant decision taken at the 1324 th meeting); and that the closure of the remaining cases therefore in no way prejudges the Committee’s continuing evaluation of the general measures required to prevent unjustified and disproportionate interferences with the right to freedom of expression;   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in these cases as regards the individual measures and   DECIDES to
